Worth hearing petition: Nawaz Sharif's ECL case to be re-heard today

LAHORE: 16, NOVEMBER, 2019: The Lahore High Court will begin hearing of a petition filed by Shahbaz Sharif against the government's conditions to remove former Prime Minister Nawaz Sharif's name from the Exit Control List (ECL) today (Saturday).
The two-member bench headed by Justice Ali Baqir Najafi and comprising of Justice Sardar Ahmad Naeem, resumed the hearing of the case, where the federal government and NAB submitted their replies to the two-member bench.
The Lahore High Court, after hearing the arguments on whether or not the petition was worth hearing yesterday, ruled that the petition filed by Shahbaz Sharif is worth hearing.
Lahore High Court two-member bench said in its verdict that a hearing on the removal of Nawaz Sharif's name from the ECL will be held here.
After hearing the verdict, the court fixed Shahbaz Sharif's petition for hearing on November 16 today against the government terms to remove Nawaz Sharif from the ECL.
In the Lahore High Court, responses were submitted by the government and NAB in which the government's answer was consisted in 45 pages and NAB's response was 4 pages.
While, Nawaz's counsel Amjad Pervez stated that the LHC could hear the petition as the NAB was a federal institution.
The counsel argued that the condition of furnishing Rs7.5 billion surety bonds was not based on any provision of law.
After hearing the arguments, the high court reserved its judgment on the maintainability of PML-N's petition.
It later released its three-page order and rejected federal government and NAB's objection regarding maintainability of the petition.
The Federal Government and the National Accountability Bureau (NAB) in their written response challenged the jurisdiction.
The reply stated that the Lahore High Court has no authority to hear the petition. Federal government opposes expulsion of Nawaz Sharif from ECL without Indemnity Bond in written reply and Shahbaz Sharif's request to reject and to enforce the Indemnity Bond was a warning.
The government has said in its response that cases are being heard in various courts against Nawaz Sharif.
His name has been added to the ECL at NAB's request. (04)
